Novel IPR wars between generic companies?
| Generic companies are appealing to the US Congress to stop Bristol-Myers Squibb Co from a possible precedent to protect a drug from cheaper generic versions. The company is alleged to be resorting to legal strategies to keep the generic version of its block-buster diabetes medicine Glucophage from the market for three-and-half years for studying medicines' effects on children and getting permission for the same through a legislation. Since such a stoppage would involve millions of dollars loss to the generic companies on this item alone, and perhaps billions once such a precedent is allowed, there is a real IPR war between the two. Again, new type of patents wars in the thirst of MNC's for increased profits ! |
